Welcome to HEEQ. These Terms & Conditions (“Terms”) govern your use of the HEEQ website www.heeq.eu (the “Website”) and your purchase of products from HEEQ.

Please read these Terms carefully before placing an order.

By using the Website or placing an order, you acknowledge that you have read and understood these Terms. If you do not agree with these Terms, please do not use the Website or place an order.

HEEQ is an Estonian company operating its webshop, warehouse and physical retail activities in Cyprus.

Nothing in these Terms limits, excludes or affects any mandatory consumer rights that cannot legally be excluded or restricted.

In these Terms, “HEEQ”, “we”, “us” and “our” refer to Henessy Equestrian OÜ.

“Customer”, “you” and “your” refer to any person using the Website or purchasing products from HEEQ.

2. Scope of These Terms

These Terms apply to:

  • Your use of the Website;

  • Purchases made through the Website;

  • Purchases made through other HEEQ online sales channels where these Terms are provided;

  • Your interaction with HEEQ in connection with our products and services; and

  • Any other matters expressly stated in these Terms.

For purchases made at a HEEQ physical pop-up shop, the provisions of these Terms relating specifically to online purchases may not apply. Separate in-store policies may apply.

Your statutory consumer rights remain unaffected.

3. Eligibility to Purchase

By placing an order, you confirm that:

  • You are legally capable of entering into a binding contract; and

  • The information you provide to HEEQ is accurate and complete.

If you are under the legal age required to enter into a contract in your jurisdiction, you should only place an order with the involvement and permission of a parent or legal guardian where required by law.

4. Products

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and other information displayed on the Website are accurate.

However, colours displayed on your screen may vary depending on your device and screen settings.

Product images are provided for illustrative purposes and minor variations in appearance, colour or packaging may occur.

We reserve the right to:

  • Update product information;

  • Correct errors;

  • Change product availability;

  • Discontinue products; and

  • Limit quantities available for purchase,

provided that such changes do not affect an order that has already been accepted by us, except where permitted by applicable law.

5. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not guarantee that the product will remain available until checkout is completed.

If a product becomes unavailable after you place an order, we will contact you and, where appropriate, offer an alternative solution or refund any amount already paid for the unavailable product.

6. Prices

All prices displayed on the Website are stated in EUR (€) unless otherwise indicated.

Where applicable, prices include VAT and other taxes required by law.

The price applicable to your order is the price displayed on the Website at the time you place your order.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted by HEEQ.

Delivery charges, where applicable, will be displayed before you complete your purchase.

7. Promotions and Discount Codes

From time to time, HEEQ may offer promotional prices, discounts, promotional codes or other special offers.

Unless otherwise stated:

  • Promotional codes must be used before their expiry date;

  • Promotional codes cannot be exchanged for cash;

  • Promotional codes cannot be combined with other promotions;

  • Each promotional code may be subject to specific conditions; and

  • We reserve the right to correct or cancel a promotion where there has been an obvious technical or pricing error.

Any specific terms applicable to a promotion will be communicated at the time the promotion is offered.

8. Placing an Order

To place an order through the Website, you must:

  1. Select the products you wish to purchase;

  2. Add them to your shopping cart;

  3. Enter the requested billing and delivery information;

  4. Select your preferred delivery and payment method;

  5. Review your order;

  6. Accept these Terms; and

  7. Complete the payment process.

Before completing your order, you will have an opportunity to review and correct any errors in your order information.

9. Order Confirmation

After placing an order, you will receive an order confirmation by email.

An order confirmation confirms that we have received your order. It does not necessarily mean that your order has been accepted if acceptance is expressly stated to occur at a later stage.

A contract between you and HEEQ is generally formed when we confirm that your order has been accepted and/or when the products are dispatched, depending on the circumstances.

If we are unable to accept your order, we will inform you as soon as reasonably possible and refund any payment you have already made.

10. Incorrect Pricing or Information

We take reasonable care to ensure that prices and product information displayed on the Website are accurate.

If we discover an obvious pricing or product information error after you have placed an order, we may contact you before processing the order.

Where legally permitted, you may be given the option to confirm the order at the correct price or cancel the order and receive a full refund.

Nothing in this section limits your mandatory consumer rights.

11. Payment

Payment must be completed using one of the payment methods made available at checkout.

Payment information may be processed by third-party payment service providers.

HEEQ does not generally store complete payment card details.

If payment is declined or cannot be successfully processed, HEEQ may be unable to fulfil the order until payment has been successfully completed.

12. Delivery

We deliver products from our operations in Cyprus to the delivery locations made available at checkout.

Available delivery options, estimated delivery times and applicable delivery charges will be displayed before you complete your order.

Delivery times are estimates and may be affected by circumstances outside our reasonable control.

If we anticipate a significant delay, we will take reasonable steps to inform you.

Unless otherwise agreed, the goods should be delivered within the legally applicable period.

13. Delivery Address

You are responsible for providing accurate and complete delivery information.

HEEQ is not responsible for delays or failed deliveries caused by incorrect or incomplete information provided by you.

If a delivery cannot be completed because the information provided was incorrect, we may contact you to arrange a new delivery. Additional delivery costs may apply where permitted by law.

14. Risk in the Products

For consumer purchases, the risk of loss or damage to the products generally passes to you when you, or a third party designated by you other than the carrier, physically receives the products.

This does not affect your statutory rights concerning defective, damaged or non-conforming products.

15. Returns, Refunds and Cancellation

Your rights to cancel an online order, withdraw from a purchase, return products and receive a refund are described in our separate:  Refund & Returns Policy

For online consumer purchases, statutory withdrawal and consumer protection rights apply where required by applicable law.

Nothing in these Terms limits or excludes those rights.

For purchases made at a HEEQ physical pop-up shop, the separate in-store return conditions apply, without affecting statutory rights relating to faulty or non-conforming products.

16. Faulty or Non-Conforming Products

HEEQ respects all mandatory consumer rights relating to products that are faulty, defective, damaged, incorrectly described or otherwise do not conform to the sales contract.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, price reduction, refund or another appropriate remedy.

All content on the Website, including but not limited to:

  • HEEQ name and branding;
  • Logos;
  • Product photographs;
  • Images;
  • Graphics;
  • Text;
  • Designs;
  • Videos;
  • Website layout;
  • Product descriptions; and
  • Other original materials,

is owned by or licensed to HEEQ and is protected by applicable intellectual property laws.

You may access and use the Website for personal, non-commercial purposes.

You may not reproduce, copy, distribute, modify, sell, publish or commercially exploit HEEQ content without our prior written permission, except where permitted by law.

You agree not to use the Website:

  • For unlawful purposes;
  • To commit fraud;
  • To attempt to gain unauthorised access to our systems;
  • To interfere with the Website's operation;
  • To introduce malicious software or code;

HEEQ will not be responsible for delays or failure to perform its obligations where this is caused by circumstances beyond our reasonable control.

Such circumstances may include, for example:

  • Natural disasters;
  • Severe weather;
  • Fire;
  • War;
  • Terrorism;
  • Government restrictions;
  • Strikes or industrial disputes;
  • Significant transport disruption;
  • Internet or telecommunications failures;
  • Cybersecurity incidents; or
  • Other events that could not reasonably have been prevented or overcome.

Where such circumstances occur, we will take reasonable steps to minimise their impact and resume performance as soon as reasonably possible.

In particular, mandatory consumer rights applicable in Cyprus or elsewhere in the European Union remain unaffected.

Where permitted by applicable law, disputes may be subject to the jurisdiction of the competent courts.

We may update these Terms from time to time to reflect:

  • Changes to our services;
  • Changes to our Website;
  • Changes to payment or delivery methods; or
  • Changes in applicable law.

The latest version will always be published on the Website with the applicable “Last updated” date.

Changes will not retroactively affect orders that have already been accepted by HEEQ, except where required or permitted by law.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be replaced or interpreted in a manner that most closely reflects its original purpose while complying with applicable law.

29. Entire Agreement

These Terms, together with the policies and documents expressly referred to in them, form the applicable terms governing your use of the Website and your purchases from HEEQ.

Where there is a conflict between these Terms and a mandatory consumer right, the mandatory consumer right will prevail.
